article 1728 du Code civil dispose que le preneur est tenu d&#8217; \u00ab user de la chose (\u2026) selon la destination qui lui a \u00e9t\u00e9 donn\u00e9e par le bail, ou suivant celle pr\u00e9sum\u00e9e par les circonstances \u00e0 d\u00e9faut de convention \u00bb. Cette obligation est consid\u00e9r\u00e9e comme essentielle. Pour preuve, l\u2019article 1729 de ce m\u00eame Code pr\u00e9voit que \u00ab Si le preneur emploie la chose lou\u00e9e \u00e0 un autre usage que celui auquel elle a \u00e9t\u00e9 destin\u00e9e [&#8230;] le bailleur peut [&#8230;] faire r\u00e9silier le bail. \u00bb. La sanction est donc particuli\u00e8rement s\u00e9v\u00e8re.<\/p><p>\u00a0<\/p><p>Ainsi, la destination de l\u2019immeuble commercial est un enjeu majeur du bail. Comme tout enjeu impliquant des int\u00e9r\u00eats parfois contradictoires, il oscille constamment entre deux \u00e9tats antagonistes. D\u2019une part, le bailleur aspire \u00e0 la sp\u00e9cialisation de l\u2019usage de son local. Cette recherche, qu\u2019elle soit volontaire ou impos\u00e9e par la situation de l\u2019immeuble, lui permet de maitriser les activit\u00e9s commerciales s\u2019exer\u00e7ant dans son bien. D\u2019autre part et \u00e0 l\u2019inverse le preneur est g\u00e9n\u00e9ralement en qu\u00eate de d\u00e9sp\u00e9cialisation. Cette ouverture va lui permettre d\u2019accroitre le champ des activit\u00e9s envisageables et par la m\u00eame, la valeur de son fonds.<\/p><p>\u00a0<\/p><p>En somme, la destination du bail commercial est en perp\u00e9tuelle recherche d\u2019\u00e9quilibre entre sp\u00e9cialisation (I) et d\u00e9sp\u00e9cialisation (II).<\/p><p>\u00a0<\/p><p><u><b>I \u2013
